Cross-Border Hiring

Cross-border hiring is the practice of recruiting and employing workers who are located in a country different from the hiring company's home base. This has become an increasingly common strategy as remote work technology has matured and companies look beyond their domestic borders to access specialized skills, reduce hiring costs, or build coverage across multiple time zones. Cross-border hiring introduces a set of legal and administrative considerations that domestic hiring does not, since the company must ensure the employment relationship complies with the labor laws, tax requirements, and statutory benefits obligations of the worker's country, not just its own. Attempting to hire someone across borders using a standard domestic employment contract, or worse, misclassifying them as an independent contractor to avoid this complexity, can expose the company to significant compliance risk. The most common and lowest-risk way to execute cross-border hiring today is through an Employer of Record, which legally employs the worker on the company's behalf in their home country. This allows the hiring company to onboard talent quickly and compliantly, regardless of where that person is physically located, without needing to establish its own legal entity in every country it hires from.
