Compensatory Off

What is Compensatory Off?

Compensatory off, often called comp off, is paid time off granted to an employee in exchange for working on a day that is normally a weekly off or a public holiday, or for working extra hours beyond the normal schedule. Instead of receiving overtime pay, the employee takes an equivalent day or half day off at a later date. Compensatory off is common across Indian companies, especially in technology and support roles that need occasional weekend work.

For US companies with offshore teams, compensatory off solves a practical problem. When an Indian engineer supports a late-night US release or a weekend deployment, a clear comp off rule keeps the person fairly rewarded without complex overtime calculations.

Is Compensatory Off a Legal Requirement?

There is no single central law that gives every private employee a compensatory off entitlement. The rule depends on the type of establishment and the state. The Factories Act requires a compensatory holiday for factory workers who lose a weekly rest day, and several state shops and establishments acts have comparable provisions. For office-based technology staff, comp off is usually a policy choice written into the contract or handbook.

How Compensatory Off Works

An employee works on an approved holiday or weekend, the manager records it, and the HR system credits comp off to the balance. The employee then applies for leave against that balance within a defined period, often 30 to 90 days. If the credit expires unused, the policy may either lapse it or convert it to cash.

Compensatory Off vs Overtime Pay

Overtime pay compensates extra hours with extra money, commonly at twice the ordinary rate for covered workers under wage laws. Comp off compensates with time. Some employers allow staff to choose, while others set one method by role. Note that statutory overtime protections apply to certain categories of workers, so employers must check whether employees are covered before replacing pay with time off.

Designing a Compensatory Off Policy

A good policy defines who is eligible, what qualifies for credit, the minimum hours required for a full or half day, who approves, the validity period, how to apply and whether unused balance expires or is encashed. It should also explain whether comp off can be combined with other leave and whether it carries over to the next year.

Compensatory Off Eligibility and Approval

Many companies grant comp off only to non-exempt or junior staff, while senior managers are expected to absorb occasional extra work. Whatever rule applies, require advance written approval so that work on a rest day is authorised, and so records can show why it was credited.

Recording and Tracking Compensatory Off

Use the leave management system to log the date worked, hours, approver and expiry date. Without clear records, disputes arise about how many credits an employee holds. Reports should show outstanding balances so finance can estimate liability.

Working Across Time Zones

India Standard Time is UTC+5:30, so a US evening meeting can run late at night in India. Teams should decide whether late-night work counts for comp off or is part of a flexible schedule. A shifted workday that stays within normal hours often does not qualify, while a call that extends beyond the regular shift may.

Compensatory Off Expiry and Encashment

Policies differ on whether unused comp off lapses or is paid out. If it is paid, the amount is taxable salary and subject to TDS. If it expires, communicate the deadline in advance. Courts and labour authorities look at fairness, so avoid rules that quietly cancel earned time.

Common Compensatory Off Mistakes

Typical errors include verbal promises with no record, unlimited validity, inconsistent treatment of employees, treating comp off as a substitute for statutory rest days, and not accounting for balances when an employee resigns.

Handling Comp Off at Exit

When an employee leaves, decide in the policy whether unused balance is paid in the final settlement or forfeited. Many companies allow employees to use balance during the notice period, subject to manager approval.

Compensatory Off for Holiday Work

India has national holidays such as Republic Day, Independence Day and Gandhi Jayanti, along with state and festival holidays. If a team member must work on one of these days to support a US deadline, comp off is the usual remedy. Some contracts require double pay for work on a declared holiday, so check whether state rules or the employment agreement call for payment, time off or both. A clear rule for holiday work removes doubt for managers who assign tasks on short notice.

Half-Day and Hourly Credits

Many policies credit a full day for work of six to eight hours and a half day for four hours. Some firms track credits in hours. Define the thresholds, the rounding method and the minimum block of time that can be taken as leave. These details prevent arguments when an employee works five hours on a Sunday and expects a full day of compensatory off.

Budgeting and Liability

Accumulated balances are a hidden cost. Each unused day is a day of paid absence that the company owes. HR and finance should review balances quarterly, flag employees with large credits, and encourage them to take time off. Where policy allows encashment, accrue the estimated liability in the books, since a cash payout will fall due at exit or expiry.

Employee Wellbeing

Frequent weekend work erodes morale even when comp off is granted. If the same people regularly support US-hour releases, consider rotating duties, hiring for coverage or adjusting shifts. Comp off is a tool for occasional exceptions, not a permanent substitute for staffing. Tracking how often credits are earned shows whether workloads are sustainable.

Documentation Checklist

Keep the policy text, signed acknowledgement from employees, manager approvals, records of credits and usage, expiry reports and settlement calculations. These documents help resolve disputes and prove consistent treatment during a labour inspection or audit.

Sample Policy Wording

A short clause might read: “Employees who work on a weekly off or public holiday with prior written approval from their manager will receive compensatory off of equal duration. The credit must be used within 60 days and cannot be carried forward.” Adapt the text to fit your location, role types and legal advice, and review it every year.
