Most US founders who hire in India know they need to handle PF. What is ESIC is the question that comes up later, usually when a compliance gap surfaces or a payroll audit flags a missed registration.

What is ESIC compliance in practice? Not complicated. The contribution rates are fixed, the wage threshold is clear, and the monthly deadline is the same every cycle. What creates problems is the cluster of assumptions US employers carry: that ESIC only applies to factories, that all engineers earn above the threshold, that the EOR handles everything without any input from the client company.

None of those are safe to assume. If you have 10 or more employees in India and any of them earn under INR 21,000 per month in gross wages, what is ESIC becomes a question your payroll process needs to answer correctly before the next deposit is due.

ESIC Full Form and What the Scheme Does

ESIC full form is Employees' State Insurance Corporation. It is the statutory body established under the ESI Act, 1948, and it administers the ESI scheme across India under the Ministry of Labour and Employment.

What is ESIC in practice? It is a self-financing social security program that covers eligible employees and their dependents for medical care, sickness pay, maternity benefits, disability compensation, and a dependent benefit paid to the family of an employee who dies due to a work-related injury.

For an engineer or support staff member earning INR 18,000 per month in Hyderabad, what is ESIC means access to medical care for the employee and their family, cash compensation at 70% of wages during certified illness for up to 91 days annually, paid maternity leave funded through the scheme, and wage replacement during a workplace disability. These are not token benefits. They are meaningful social protection for employees below the wage ceiling.

For a US employer, what is ESIC on the payroll side is a mandatory monthly contribution calculated on gross wages. It is statutory, not optional, and it applies from the month the establishment crosses the 10-employee threshold.

Who Must Register Under What Is ESIC: The 10-Employee Threshold

Any factory or notified establishment in India with 10 or more employees must register with ESIC and contribute for every covered employee. What is ESIC registration? It is mandatory enrollment with the ESIC portal before the first payroll cycle after crossing the threshold. In some states and for certain establishment categories, the threshold is 20 employees rather than 10. But for most organized-sector businesses, including IT companies, product firms, software development centers, and GCCs, the 10-employee threshold applies.

The headcount for ESIC is not limited to permanent full-time staff. Contract workers, casual employees, fixed-term workers, and temporary staff all count toward the threshold if they work at or for the establishment. A company with eight permanent employees and four contract workers on-site has crossed the threshold, whether those contract workers are on a separate vendor payroll or not.

Many IT companies and GCCs assume what is ESIC does not apply to them because they are not a factory or an industrial unit. That assumption is wrong. The ESI Act applies to any establishment with 10 or more employees, regardless of industry. Tech companies, SaaS product teams, and engineering-only offices are all covered establishments under the Act.

Once the 10-employee count is reached, ESIC registration must happen before the next payroll cycle. The employer initiates it. The ESIC portal does not trigger automatically at hire number 10.

What Is ESIC Wage Ceiling: Who Is Covered and Who Is Not

What is ESIC eligibility for individual employees? It is salary-gated. Any employee earning up to INR 21,000 per month in gross wages is a covered employee. Any employee earning above INR 21,000 is outside the scheme, and no contributions are due on their wages. For persons with disabilities, the ceiling is INR 25,000 per month, with a reduced employer contribution rate of 1%.

Most mid-to-senior tech hires in India earn above INR 21,000. A software engineer with four to five years of experience in Bengaluru or Hyderabad earns INR 60,000 to INR 1,20,000 per month. What is ESIC for them? Not applicable. No contributions are deducted or deposited for employees above the ceiling.

But junior engineers, interns, QA analysts in early roles, administrative staff, and operations personnel frequently fall below INR 21,000. Contract workers and vendor staff on-site often do too. If any one of them earns under the ceiling at a covered establishment, what ESIC means is a mandatory contribution that must be calculated and deposited every month.

The establishment-level obligation and the individual employee-level obligation are separate. The establishment must be registered once the 10-employee threshold is crossed, regardless of how many of those employees actually earn below INR 21,000.

What Counts as Wages for What Is ESIC Calculation

What is ESIC calculated on? Gross wages, but with specific inclusions and exclusions.

ESI wages include basic pay, Dearness Allowance, HRA, City Compensatory Allowance, attendance allowance, and other regular monthly allowances. Overtime pay, bonuses, gratuity, and reimbursements are generally excluded from the ESIC wage base.

One change US employers need to know about: the 50% wage rule under India's new labour codes is now enforceable. Restructuring salary components to keep the basic component artificially low — inflating allowances to suppress the ESIC-applicable wage base, is no longer a workable strategy. The basic plus DA component must be at least 50% of gross CTC. Payroll structures built around this workaround now carry a compliance risk rather than a tax planning benefit.

What Is ESIC Contribution Rate in 2026

What is ESIC contribution rate in 2026? A total of 4% of gross wages, split between employer and employee.

The employer contributes 3.25% of each covered employee's gross wages. This is a direct employer cost and is not deducted from the employee's salary. Under Section 73 of the ESI Act, deducting the employer's 3.25% from the employee's wages is a criminal offence punishable with imprisonment. The employer's share must always come from the employer's own funds.

The employee's contribution is 0.75% of gross wages, deducted at source each month. Employees whose daily average wage is INR 176 or less are exempt from the employee contribution, though the employer must still deposit the full 3.25% employer share for them.

A Worked Example

For an employee earning INR 18,000 gross per month:

 These numbers are small per employee. Across a workforce of junior and mid-level staff, they add up quickly, and the penalties for getting what is ESIC wrong are larger than the contributions themselves.

What Is ESIC Coverage Exit: The Contribution Period Rule

When an employee's gross salary rises above INR 21,000, what is ESIC coverage does not end in that month. Coverage continues until the end of the contribution period in which the salary increase took effect. Contribution periods run from April to September and from October to March.

An employee whose salary crosses INR 21,000 in June continues under ESIC until September 30, not from June. An employee whose salary crosses in November continues until March 31.

This is one of the most common payroll errors for India teams managed remotely from the US. The month of increment is not the exit date. The end of the contribution period is. Stopping contributions in the month of the salary increase creates an underpayment. Continuing deductions past the correct contribution period end creates an over-deduction from the employee.

Build this into your payroll tracking. Whenever an India hire crosses the INR 21,000 ceiling, log the contribution period end date, not just the salary change date. What is ESIC coverage for that employee does not stop at the date of the pay revision, it stops at the end of the period.

What Is ESIC Filing Deadline and Penalty Structure

Employers must deposit both contributions, employer and employee share combined, through the ESIC portal by the 15th of the month following the contribution month. Contributions for April are due by May 15. Contributions for July are due by August 15.

Missing that deadline triggers two simultaneous costs. Simple interest at 12% per annum runs on the outstanding amount from the due date. Additionally, ESIC levies graded damages based on how long the delay runs:

●        5% per annum for delays up to two months

●        10% for two to four months

●        15% for four to six months

●        25% for delays beyond six months

Beyond interest and damages, persistent non-registration or non-payment can result in fines of up to INR 10,000 and imprisonment of up to two to three years for the employer.

These penalties are backdated to when the default began, not to when it is discovered. An ESIC audit that surfaces a two-year gap in registration generates what is ESIC liability from the date the establishment first crossed the 10-employee threshold, not from the audit date.

What Is ESIC Responsibility When You Use an EOR in India

When you hire in India through an Employer of Record, what is ESIC becomes the EOR's statutory obligation. It registers the establishment, enrolls covered employees, calculates contributions, and deposits them by the 15th each month.

●        Active verification. Ask your EOR directly: which employees are enrolled in ESIC, which have exited coverage due to salary increases, and when was the last monthly return filed? An EOR confident in its compliance answers those questions immediately.

 For US companies managing payroll directly through their own India entity, the ESIC deposit deadline of the 15th runs in parallel with the PF deposit deadline of the same date. Both are fixed monthly obligations. Missing either triggers backdated interest, not prospective.
