I-9 Verification
I-9 Verification is the federally mandated process U.S. employers must complete to confirm the identity and legal work authorization of every new employee hired to work within the United States. Named after Form I-9, this process requires the employee to present specific original documents, such as a passport or a combination of other approved identification and work authorization documents, which the employer then reviews and records. The I-9 process must generally be completed within a specific window after an employee's start date, with the employee responsible for completing their portion of the form and providing acceptable documentation, and the employer responsible for reviewing those documents, confirming they appear genuine and related to the individual presenting them, and completing the employer's certification section. Employers are prohibited from requesting specific documents beyond what the employee chooses to present from the list of acceptable options. I-9 Verification applies specifically to domestic employment within the United States and does not extend to workers employed internationally. Employers must retain completed I-9 forms according to specific retention requirements and can face significant penalties for failing to properly complete or retain these forms for their U.S. workforce.
